The tracking data provides us with collective information about how our users are using the website but does not identify or track an individual user behaviour. Secondly cookies are used to allow visitors to add comments to the blog section of the website.

We may display any photographs to promote Colin Lavery Photography on the Colin Lavery Photography website and blog, on social media, on wedding blogs, on wedding photography related websites, in exhibitions, in advertising, brochures, magazine articles and other such material, providing that the images used are used lawfully and without damage to Colin Lavery Photography's  client(s). The rights of the people captured in these photographs are protected by Colin Lavery Photography as detailed in this privacy policy.


DISPLAY OF IMAGES


We adopt a safe and responsible Social Media Policy. While we may have official profiles on social media platforms users are advised to verify the authenticity of such profiles before engaging with, or sharing information with such profiles. We will never ask for personal details on social media platforms. Users are advised to conduct themselves appropriately when engaging with us on social media.

SOCIAL MEDIA POLICY & USAGE


Anyone photographed by Colin Lavery Photography, whether a client or wedding guest, and whether past or current may withdraw consent for a photograph in which they appear to be displayed. If you wish to withdraw consent please email Colin Lavery Photography at hello@colinlaveryphotography.com specifying the photo in question. Persuant to the request, Colin Lavery Photography will then remove the photo from online and printed display wheresoever it appears.


WITHDRAWAL OF CONSENT


Under GDPR legislation, a photograph may in some instances constitute a form of personal data where they can be processed to allow “the unique identification or authentication of a natural person”. Colin Lavery Photography will never photograph an individual as a means of unique identification or authentication unless consensually contracted to do so. Guests at weddings appear in photos taken by Colin Lavery Photography as a part of the visual recording of the event in photos. Guests captured in portraits or in group photos do so as part of the event and their rights are protected by Colin Lavery Photography as detailed in this privacy policy.

In terms of explicit GDPR compliance, wedding clients and guests are photographed within the parameters of GDPR legislation on the basis of ‘legitimate interests’. The taking of photographs of wedding guests when viewed as a form of processing personal data is necessary for the legitimate interests of Colin Lavery Photography as a photography business unless there is a good reason to protect a given individual’s personal data which overrides those legitimate interests. 

Operating within the parameters of legitimate interests as laid out in GDPR legislation, the disproportionate effort involved in providing privacy policy information to all wedding guests at the event and the degree to which it would distract us from performing our job renders it infeasible to do. Wedding clients are therefore requested to direct their guests to read this privacy policy in advance of the event and to advise them to contact us in advance with any concerns around the processing of their personal data, namely being photographed.



CLIENTS AND WEDDING GUESTS CAPTURED IN PHOTOS

We take great care over the processes around looking after personal data stored on our physical systems. Colin Lavery Photography holds the following personal data of clients: 
  1. names
  2. addresses 
  3. phone numbers
  4. email addresses
within hard copy and sometimes soft copy contracts as well as soft copy wedding client ‘itinerary’ documents. Soft copy contracts and day plans are safely stored on my password protected home office iMac and also kept on file on GDPR compliant webmail servers. Hard copy contracts are stored in a lockable fire-safe filing system.

Client photos are safely stored within my password protected home office MacBook and backed up to two encrypted external hard drives. An additional cloud copy of all images is stored on GDPR compliant Dropbox.

CLIENT DATA HELD ON FILE

Although we only look to include quality, safe and relevant external links, users are advised to adopt a policy of caution before clicking any external web links mentioned throughout this website.

We cannot guarantee or verify the contents of any externally linked website despite our best efforts. Users should therefore note that they click on external links at their own risk and we cannot be held liable for any damages or implications caused by visiting any external links mentioned.

EXTERNAL WEBSITE LINKS & THIRD PARTIES

We use Pass Gallery to host and deliver client photo galleries. When accessing a gallery, you may be asked to enter your email or other personal details. Please note that Pass Gallery operates under its own privacy policy, which you can view here: https://passgallery.com/privacy.

Only Colin Lavery will have access to your personal data (email address) stored on Pixieset’s system on behalf of Colin Lavery Photography. It will only be used as detailed above, will not be used for any other marketing purposes and will not be passed onto any third parties. Pass Gallery’s technical support team will have the means to access to your personal data (email address) but will never access or share this data other than by request from Colin Lavery.

By logging into a Colin Lavery Photography client gallery you are agreeing to opt in to receive relevant, gallery-specific emails as described above. Emails are automated so if you do not wish to receive such emails it is advised that you do not log into any Colin Lavery Photography client galleries.

CLIENT GALLERIES

Occasionally emails will be sent out with album discounts or promotional offers relating to other photography aspects however this is never more than twice a year. Please email hello@colinlaveryphotography.com if you do not wish to be included in this. Your personal details will never be passed on to third parties for marketing purposes.

EMAIL MARKETING

Contact Forms:
Minimum data is requested via the secure contact form and we have provided other means of contact (email, phone and social media) should you prefer. The data from these forms is emailed to the address listed above and also stored on the website server, in most cases dating back to when each form was created. The website server is accessible by the website administrators for https://colinlaveryphotography.com/ at Squarespace. 

We use Google Workspace (Gmail) to manage our email communications. Any personal information you provide via email, such as your name, email address, and event details, may be stored on Google’s servers and processed according to Google’s Privacy Policy.

Google Workspace provides robust security features, including encryption in transit and at rest, to help protect your personal information.

By completing these contact forms you agree to Colin Lavery contacting you about Colin Lavery Photography’s services namely wedding and photographic related details. You will not be added to any mailing lists and will only be contacted by Colin Lavery personally in relation to your enquiry. Your personal details will not be added to any client or studio management software, will not be used for any marketing purposes nor will they be passed onto any third parties. They will only be stored in the email generated by these contact forms which will be filed in the email account for Colin Lavery Photography which is an email account hosted by SiteGround and which can only be accessed by Colin Lavert.
